The event will NOT be considered a “Booked Event” until the retainer/deposit has been received. If the host has agreed to a date, yet the retainer/deposit has not been received, another event might seek to book that date. In this case, The Amazing Chemistry Show will contact the original event host and provide 24 hours for the host to provide a retainer/deposit; otherwise, the date may be taken by another group.

Once the retainer/deposit is received, the event date is blocked off and reserved for the organization that placed the retainer/deposit. The booked event will be published on our website, posted on social media, and in our weekly newsletter. If a date is booked, it will be unavailable for other events to book. Had the date been open, it would have been booked by someone else.

The retainer/deposit amounts are not refundable, with the exception of a Force Majeure Clause (Act of God).

Force Majeure / Events Beyond Control:

Neither party will be considered in breach of this agreement if performance is prevented due to circumstances beyond the reasonable control of that party, including but not limited to: fire, flood, earthquake, hurricane, tornado, severe storm causing dangerous travel conditions, pandemic, war, terrorism, civil unrest, government orders, venue closure, declared public health emergencies, or interruption of essential utilities at the venue. Force Majeure applies only when the event is illegal, impossible, or unsafe to hold, and not merely because (1) attendance is expected to be low, (2) budgets change, (3) staffing changes, (4) facility renovations fall behind schedule, or (5) the event becomes undesirable. (6) Weather forecasts alone do not qualify as a Force Majeure. Weather qualifies only if a government agency issues a travel advisory, the venue is unusable, or travel is unsafe in the Performer’s reasonable judgment.

If Force Majeure occurs, the client may either:

(1)  apply all payments made toward a rescheduled performance date within nine (9) months, subject to the performer’s availability, OR (2) receive a refund of the retainer/deposit.

Canceling but NOT Force Majeure:

If the host chooses to cancel and it is NOT a Force Majeure, the retainer/deposit will be forfeited. Determination of Force Majeure will be made in good faith based on objective conditions, including venue status, government orders, and travel safety.

Discounted Shows + Rebooking Events:

At the time of booking, The Amazing Chemistry Show may have been booked by another event close to your area. This may have resulted in a reduction in the cost for your event. If your event was (1) booked as a “discounted” event, (2) the host chooses to cancel, and (3) the rationale for canceling qualified to rebook the event within the 9-month window, any discounted pricing is not guaranteed for a rescheduled date. (4) Rebooking a date is subject to availability and considered a new agreement.
